Karl was willing to sign nothing, so whatever he said, it had no force. In
particular he established an absolutely solid track record of antagonism
and being willing to say whatever is convenient for his purposes. So
whatever he claims at one point, there is every reason to believe he will
claim something else later, if it suites him.
Now he is under a court directive. That is quite different.
For all of the negative publicity that ICANN is getting from this, I
believe that they had no choice but to treat Karl as likely to act
irresponsibly with information he obtains.
In other words:
ICANN may have lost the suit, but
they won the controls over Karl that they sought.
