I would hope NCUC takes a firm stand that “ICANN shall not regulate” means ICANN or its agents may not enforce rules about internet content, no matter how indirect the enforcement, and no matter how carefully the rules are crafted. Comments to the board can reference the Protect the Stack coalition statement (https://protectthestack.org/) which lays out the reasons why content policing should not be done at the infrastructure level, including DNS.
