The TMCH is not a list of protected names. It is a list of names (for
which TM is verified) on which 1) when there is registration there is
notice and 2) there is a sunrise period that allow the buying beforehand.
The spirit of the TMCH isn't to protect the names from use by anyone
else. The spirit and the letter of the TMCH does not imply
affordability. *That* would have been a pretty big bias in favor of IP
interests for some names. if the names are more valuable in a context
they are more valuable (as long as there is competition).
