Update: WHOIS data and today's Council meeting

Today was a good day on the GNSO Council call. Robin and Norbert attended as
our reps; I was there with a few WHOIS Task Force members. When the issue
came up Jordyn Buchanan (TF Chair) and I were asked to speak about our concerns.
We raised the issue of notice and consent (on WHOIS data) creating an
unintentional waiver -- and we both asked that the Council examine this issue
closely before voting to adopt the WHOIS Notice and Consent Recommendation.
I was surprised at how much support we received. The Registrars, led by Ross
Rader on this issue, continued their strong leadership on this issue. Also
the Registries and ALAC. Ultimately, the Council agreed by **unanimous vote**
not to vote to adopt the WHOIS Notice and Consent Recommendation at this time.
I would like to extend a special thanks to NCUC member Marc Rotenberg,
Director of the Electronic Privacy Information Center. Marc raised the waiver issue
and coached me through its nuances (which I then shared in many private
questions with other constituencies). Marc also wrote the eloquent statement
Milton circulated a few hours ago. Marc, your statement will drive the future work
by Council and questions being relayed to ICANN's General Counsel -- thank
you.
Also a big thanks to Robin and Norbert. You attended this important call at
crazy hours and with terrible phone connections, but without your leadership
today, this issue would probably have moved forward. Thank you. The issue is
now in your (Council) court. Please let me and Milton know what we can do to
help.
