Yes. It seems that the lawyer who responded has not understood what Joe
Sims has built. The ICANN is a corporation not a political party. Is it
legal in the US to select a Corporation Director on his poltical opinions
or religious faith?
It is very unlikely after such a response that any Gov and ITU/T is going
to buy that ICANN is only a small technical non-profit corporation.
Also a non discriminatory action is required. That every BoD Member
discloses his own position on the points the ICANN documents on Karl. Since
it appears that the ICANN considers the positions on that points as
technically important. That is, unless there is a Staff's "black list".
Question: has the BoD authorized that response? It concerns a BoD Member,
ie one Member of the decision body. It seems surprising to a non
Californian person that the corporation staff, ie the excution body, may
handle such a case alone.
The Staff objects to Karl that he did not address the problem with the BoD,
but it seems that the Staff does the same. This would leads a casual
observer to think that everynoe agrees that neither the BoD nor the Staff
positions count, only JDRP's.
