Sponsored Restricted vs Sponsored Unrestricted vs Unesponsored Re: [ncdnhc-discuss] guidance on .org

Milton and all:

I want to comment about some points that in my opinion address better
what it should be the Non-Commercial interests inside .ORG.

Before we have to begin with the basic definitions:

Unesponsored:  First of all, TLDs that are Unesponsored has to abide to
the regular Registry TLD agreement that can be found in
http://www.icann.org/tlds/agreements/unsponsored/registry-agmt-01aug01.htm
Unesponsored, simply to be a Registry Operator. Also the way to achieve
consensus on policy can be found in the URL above
section 4.3

Sponsored:  As defined in http://www.icann.org/tlds/

"Sponsor is an organization to which ICANN delegates some defined
ongoing policy-formulation
authority regarding the manner in which a particular sponsored TLD is
operated. The sponsored TLD has a Charter,
which defines the purpose for which the sponsored TLD has been created
and will be operated. The Sponsor is
responsible for developing policies on the delegated topics so that the
TLD is operated for the benefit of a defined
group of stakeholders, known as the Sponsored TLD Community, that are
most directly interested in the operation
of the TLD. The Sponsor also is responsible for selecting the registry
operator and to varying degrees for establishing
the roles played by registrars and their relationship with the registry
operator. The Sponsor must exercise its
delegated authority according to fairness standards and in a manner that
is representative of the Sponsored TLD
Community".

Now, having reading carefully about what it means Sponsored and
Unesponsored, the following analisis is:

1.  Since the NCDNHC has decided that .ORG is of the interest of the
Non-Commercial Community, then .ORG should be Sponsored
because finally the Non-Commercial sector can guarantee a TLD addressed
to the Non-Commercial sector and Non-Commercial legimit activities.  
To be an Unesponosored Registry for .ORG means to leave in the hands of
other interests the management of .ORG and the policy making process
inside .ORG.  I am sure that NCDNHC doesn't wants to leave .ORG
management in the hands of interests contrary to the Non-Commercial
ones.
So the conclusion here is: .ORG should be SPONSORED.

2.  Now the battle-horse:  SPONSORED UNRESTRICTED or RESTRICTED.    If
we read again the definition of SPONSORED TLD, such has a CHARTER which
defines the purpose of which the sponosored TLD has been created and
will be operated.   Having a CHARTER means to DEFINE and RESTRICT. 
Since
SPONSORED TLDs by definition has a CHARTER, then obligatorily a
SPONSORED TLD has to be RESTRICTED.  If the SPONSORED TLD doesn't have a
CHARTER then, also cannot be a SPONSORED TLD at all.  But, I am sure
that the NCDNHC doesn't wants a .ORG UNSPONSORED (because of the reason
exposed in the previous point), since the idea is that the
Non-Commercial community has full participation in Policy Making inside
.ORG and only this can be done by being SPONSORED.  

Of course, the CHARTER can be as open or as closed as the Sponsored TLD
Community decides.  

The conclusion:  If the NCDNHC wants that Non-Commercial Sector has the
proper participation in the Policy Making inside .ORG it has to be
SPONSORED and it has to have a CHARTER, which is best known as SPONSORED
RESTRICTED.  

I leave to the consideration of the NCDNHC members about what they
considers is the best for the Non-Commercial sector and legimit
activities and interests inside  .ORG.  I hope that the NCDNHC members
selects the right path to follow in .ORG.
