Milton and all:

The intention of the .ORG Divesture is not evicting any actual
Registrant solely because it doesn't complies with any future CHARTER
made by the Sponsor TLD Registry.

However, it is more than clear that the NCDNHC intentions on .ORG
Divesture is that .ORG be a Registry serving the Non-Commercial sector
Interests.

Then, for this new .ORG Registry, a brand new DRP has to be made that
clearly benefits such Non-Commercial interests.  

This could mean that, for example, if .ORG finally achieves to have a
CHARTER, then in this special DRP the clear priority and advantage
would be for those organizations/individuals that are defined in the
CHARTER as target community would have the preference when
a domain name inside .ORG is in dispute.  In this case, this apply to
all domain names inside .ORG regarless if it was registered
before or after .ORG Divesture.

For example:  A Commercial Business has registered the domain name
ABC.ORG to promote a comercial product or simply to protect
intelectual property.  However, there is a Non-Commercial Organization
dedicated to bring alphabetization to the poor people
that also is names ABC.  ABC intenteded to obtain a domain name inside
.ORG but found that ABC Commercial registered already.
Engage in a UDRP or legal suit is too expensive already for the
Non-Commercial ABC.  Worst, Non-Commercial ABC doesn't live in USA, but
Commercial ABC live in USA and .ORG Registry also is in USA.  Due to
actual rulling made by a Court in Massachusets, all UDRP Decisions
can be reviewed by a US Federal Court when TLD Registry physically is
inside USA and again, economical constraints prevents a Non-Commercial
to make any Legal Suit against a Commercial one.   Then...as you  may
see, Non-Commercial ABC doesn't have any probabilities to register
their name inside .ORG.   

With a special DRP (call it CEDRP, or whatever other name) for .ORG that
clarifies special priorities and advantage for Non-Commercial sector
would help such Non-COmmercial sector to get their domain names in a
lawful and unexpensive way.  This is also a major advantage for
those Non-Commercial Organizations in Developing Countries because we
are in clear disadvantage when any one has to face Legal Suits filled
(in USA and, in fact, anywhere) regarding the registration of a name
inside .ORG.
