<p class="MsoNormal"><span style="font-size:11.0pt;font-family:"Calibri",sans-serif;color:#1F497D">This is a good question, and I might suggest that “privacy by design” means nothing at all in the context of the Whois debates. Whois is already in place. We
could “design” the RDS, which is new, to be more respectful of individual privacy rights. The problem, however, is that there are numerous interest groups involved in the RDS process who do _<i>not</i>_ want privacy. In other words, privacy advocates don’t
get to “design” RDS all by themselves, they must engage in a political/policy development process. So the concept of “privacy by design” is not very helpful, it assumes away the problem of political contention. What we do need is effective policy development
strategists, persuasive advocates, coalition builders and, perhaps, litigators to fight, and threaten in the context of RDS development.
